By downloading, installing, or using the WinVoice software ("the Software"), you agree to be bound unconditionally by these Terms of Service. You must be at least 18 years of age to use this Software. If you do not agree to every provision of these terms, or if you do not meet the age requirement, you must not use the Software.
WinVoice is a locally hosted desktop artificial intelligence assistant designed to interface with local system applications and authorized third-party APIs (including, but not limited to, Google Workspace—such as Gmail, Calendar, Docs, Sheets, Drive, and Tasks—and Spotify). It is designed to perform automated tasks, schedule calendar events, draft emails, manage documents and spreadsheets, organize tasks, and control media playback.
You acknowledge that WinVoice utilizes Large Language Models (LLMs) which may occasionally generate unpredictable, inaccurate, or unintended outputs ("hallucinations"). You are solely and entirely responsible for any actions the assistant takes on your behalf. This includes, but is not limited to, the content of emails sent, calendar events modified, or system commands executed. You must review and authorize the assistant's outputs. We accept zero liability for errors or damages resulting from automated actions taken by the AI.
You are strictly responsible for maintaining the security of your device, your local environment, and the OAuth authorization tokens associated with your third-party integrations. You agree not to use WinVoice for any unlawful, malicious, or unauthorized purposes. Reverse engineering, exploiting, or using the software to compromise third-party services is strictly prohibited.
THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. IN NO EVENT SHALL THE AUTHORS OR COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIM, DAMAGES, OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT, OR OTHERWISE, ARISING FROM, OUT OF, OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.
To the maximum extent permitted by applicable law, in no event shall WinVoice, its creators, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Software; (b) any conduct or content of the AI assistant; or (c) unauthorized access, use, or alteration of your transmissions or data.
You agree to indemnify, defend, and hold harmless WinVoice and its affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that arise from your use of the Software or your violation of these Terms of Service.
We reserve the right to modify these terms at any time. We will always post the most current version on our website. Continued use of the Software after any modification constitutes your acceptance of the revised terms.
